After a death

Reporting a death

Call DWS at 1-877-664-6984 (Monday–Friday) to report the death and stop payments. No online death-reporting form is published; phone is the documented contact method.

Documentation for final payment

A certified copy of the death certificate plus a written application on the DWS prescribed form stating the relationship to the deceased. If no executor or administrator has been court-appointed, the application must also state that no appointment is pending. — 11.3.300.318 NMAC

Who may claim

First priority: the court-appointed executor, administrator, or personal representative. If no court appointment exists, next of kin by priority: surviving spouse (and parents of minor children), then surviving spouse alone, then surviving adult children, then surviving parents, then surviving siblings. — 11.3.300.318 NMAC

Filing deadline

Application must be filed within six months of the claimant's death. Unpaid benefits are cancelled and returned to the unemployment compensation fund if no timely claim is made. — 11.3.300.318 NMAC
