The creditor claim period of 4 months runs from the first publication of the creditor notice, which follows the executor's appointment. A claim not presented in time is barred. Every claim is barred 12 months after the date of death, whether or not notice was given.

Claims are presented to the personal representative at the address in the notice, or the court, at the creditor's choice. The address in the notice is the one claims go to, so it is the representative's own, or the court's, as the statute directs.

New Mexico does not require written notice to known creditors, and a creditor who is mailed one gets the later of the published period or the mailing window. A creditor who is mailed the notice must present the claim within four (4) months after the date of the first publication of any published notice to creditors or sixty (60) days after the date of mailing or other delivery of the notice, whichever is later. A mailed notice for each known creditor is part of the packet.

Once a week for 3 consecutive weeks, in the statute's terms: Published once a week for three successive weeks in a newspaper of general circulation in the county in which the probate proceeding is pending. New Mexico requires the publisher's affidavit of publication to be filed with the court; the newspaper provides it after the final run.
