State Unemployment Benefits in Delaware

The Delaware Department of Labor administers unemployment insurance through its Division of Unemployment Insurance. A claimant must personally request each weekly benefit payment through TeleBenefits or WebBenefits, so payments stop when the weekly requests stop. Delaware publishes no procedure for a deceased claimant, so a survivor or estate representative contacts the Division directly.

Weekly benefit requests
Benefits are not paid automatically — the claimant must request each weekly benefit payment through TeleBenefits or WebBenefits, starting with the first week claimed.
After a death
Delaware publishes no deceased-claimant procedure: the Division's claimant handbook (revised April 2020), its Claimant FAQs, and the unemployment statute (19 Del. C. ch. 33) contain no rule on a final payment to a survivor or estate. Contact the Division at 302-761-8446 or UIClaims@delaware.gov and ask how it handles the claim.
Overpayments
If it is finally determined that an individual received benefits they were not entitled to, the individual must repay the overpayment to the Department, whether it arose through fraud or mistake (19 Del. C. § 3325(a)).
