Recovery is limited to assets that pass through the recipient's probate estate or a small-estate affidavit.

Recovery is deferred while there is a surviving spouse, a surviving child under 21, or a blind or permanently and totally disabled child of any age. A waiver is required where an heir meets the undue-hardship criteria; the request is made in writing and may need supporting financial information.
