Steps to take

  1. Search wvunclaimedproperty.gov for the deceased's name and prior addresses, and run a multi-state search at missingmoney.com.
  2. File a claim as the estate representative (while the estate is open) or as an heir (if the estate is closed or was never opened), with:
    • The completed and signed claim form the Treasurer sends you
    • Proof of authority — court documents showing appointment as executor or administrator, or a recorded small estate affidavit and county clerk's certificate under W. Va. Code §44-1A-2
    • A certified copy of the will and/or final settlement from the county courthouse where the estate was filed, if the estate was probated
    • Photo identification and a document listing your Social Security number
  3. Upload the documents through wvunclaimedproperty.gov or mail them to the Unclaimed Property Division, P.O. Box 4228, Charleston, WV 25364.
  4. The administrator reviews the claim and issues a written decision within 90 days under W. Va. Code 36-8-15. Once a claim is allowed, payment must be delivered within 30 days.

Search wvunclaimedproperty.gov, then file a claim with the State Treasurer's Unclaimed Property Division. If a probate court named you executor or administrator and the estate is still open, you file on behalf of the estate. If the estate has been closed, or the owner had no will or estate, the surviving spouse or other heirs file. The Treasurer emails each claimant the specific documents their claim requires, which generally include the signed claim form, photo identification, and proof of authority over the estate.

Under W. Va. Code 36-8-15, the administrator must allow or deny a filed claim within 90 days and give the claimant written notice of the decision.

West Virginia holds unclaimed property until it is claimed, so there is generally no deadline for owners or heirs to file a claim.
