The letters to banks and online services can go out as soon as there is a death certificate. Whether the estate needs the court forms depends on its size: an estate under the state's small estate limit is collected with the small estate affidavit after the waiting period, and a larger one opens with the petition for probate and letters. The Probate Decision Tool answers the size question for each state.
The court forms (petition, renunciation, small estate affidavit, affidavit of heirship, notice to creditors, inventory, closing) are built to the rules of the state chosen, and each has a page per state where the state produces that document. The letter of instruction is keyed to the bank, brokerage, or insurer, and the digital assets recovery letter to the online service's deceased-user program. The EIN application is federal and has no state axis.
A trustee settling a revocable trust after the grantor's death applies for the trust's EIN, sends the letter of instruction to each institution that holds trust assets, and sends the digital assets recovery letter for online accounts. The court forms apply only where property sits outside the trust and an estate is opened for it.
