Heir claim documents
Certified Letters Testamentary or Letters of Administration when the estate is probated; small-estate or affidavit documentation otherwise; proof of death and identification.
Holding period
Utah holds unclaimed property until claimed; there is no deadline for the owner or their heirs to file a claim.
Small estate option
Heirs may use a notarized small estate affidavit under Utah Code 75-3-1201 in lieu of Letters Testamentary when the entire estate subject to administration (wherever located, less liens and encumbrances) does not exceed $100,000 and at least 30 days have passed since death. The affidavit covers personal property only; real property cannot be transferred this way.
Claim processing time
The administrator must allow or deny the claim and notify the claimant within 90 days of filing. If no action is taken within 90 days, the claim is considered denied (Utah Code 67-4a-601(7)).
