Heir claim
A person claiming an interest in the property files a verified claim on the Treasurer's form. For a deceased owner, the claim is supported by proof of death and proof of authority to act for the estate or as heir.
Decision window
The administrator considers each filed claim within 90 days and gives written notice if the claim is denied in whole or in part (K.S.A. 58-3957).
Small estate option
If the total probatable estate does not exceed $75,000 (personal property only, not real estate), an heir may use the K.S.A. 59-1507b affidavit — in the Judicial Council form — to transfer property to successors without Letters of Administration or Letters Testamentary. The affidavit, together with a death certificate, may also support an unclaimed-property claim in lieu of full probate (threshold raised from $40,000 to $75,000 effective July 1, 2023 by HB 2130).
