Small estate option
Heirs may use a notarized Small Estate Affidavit (State Form 54985) to claim assets — including unclaimed property — without full probate when the gross estate does not exceed $100,000 (for deaths after June 30, 2022). The affidavit may not be presented until 45 days after the date of death, and no petition for appointment of a personal representative may be pending. Ind. Code 29-1-8-1.
