The death should be reported to the Virginia Employment Commission so payments stop. Any benefit issued for weeks after the date of death must be returned, and VEC determines whether a final payment is owed for eligible weeks before death.
Under 16VAC5-60-30 of the Virginia Administrative Code, any benefits owed for weeks the claimant was eligible before death are payable to the decedent's estate. The executor or court-appointed administrator claims the payment on behalf of the estate by providing proof of death.
