The death should be reported to the Department of Workforce Solutions so payments stop. The Department determines whether a final payment is owed for eligible weeks before the date of death, and any payment issued for weeks after death must be returned.

Under 11.3.300.318 NMAC, the court-appointed executor, administrator, or personal representative has first priority. If no court appointment exists, next of kin may claim in this order: surviving spouse (and parents of minor children), surviving spouse alone, surviving adult children, surviving parents, or surviving siblings. A written application on the DWS prescribed form, a certified copy of the death certificate, and proof of the applicant's relationship to the deceased must be submitted within six months of death.
