Heir claim documents

Decision window
The administrator allows or denies a filed owner claim within 90 days and gives written notice; an allowed claim is paid within 60 days (N.D.C.C. 47-30.2-51, 47-30.2-52).
Small estate option
If the entire estate (wherever located, less liens and encumbrances) does not exceed $100,000, at least 30 days have passed since death, and no probate proceeding is pending or completed, an heir may submit the Affidavit for Collection of Personal Property of the Decedent (ND DOT Form SFN 2916) in lieu of Letters Testamentary. The $100,000 threshold was raised from $50,000 by HB 1224, signed 2025-03-21 (N.D.C.C. 30.1-23-01).
