Benefits that were due to the claimant for weeks before the death but remain unpaid do not simply lapse: ORS 657.255(2) allows the Department to pay them to a survivor.
ORS 657.255(2) sets the order: the surviving spouse; then surviving children, including adopted children; then the mother or father of the deceased.
