Steps to take

  1. Report the claimant's death to the Delaware Division of Unemployment Insurance at 302-761-8446 or UIClaims@delaware.gov.
  2. Ask the Division how it handles a claim after the claimant has died, and what it requires from a survivor or estate representative — Delaware publishes no written procedure for this.
  3. Expect the Division to seek repayment of any benefits the claimant was not entitled to receive (19 Del. C. § 3325(a)).

Frequently asked questions

The Delaware Department of Labor administers unemployment insurance through its Division of Unemployment Insurance. The statewide UI information hotline is 302-761-8446, and questions can be emailed to UIClaims@delaware.gov.

Delaware does not publish a deceased-claimant procedure — its claimant handbook, Claimant FAQs, and unemployment statute (19 Del. C. ch. 33) are silent on final payments to a survivor or estate. Because a claimant must personally request each weekly benefit payment through TeleBenefits or WebBenefits, payments stop when those requests stop. Contact the Division at 302-761-8446 or UIClaims@delaware.gov to report the death and ask how it handles the claim; benefits an individual was not entitled to receive must be repaid (19 Del. C. § 3325(a)).
