Heir claim documents
For a deceased owner, the claimant submits proof of death and proof of the legal right to receive the property, such as probate documents or evidence of the relationship to the deceased.
Small estate option
An heir may present a sworn affidavit (18-C M.R.S. §3-1201) to claim personal property — including unclaimed property — without opening a full probate estate, provided: (1) the entire estate, less liens and encumbrances, does not exceed $40,000 (inflation-adjusted annually by county probate courts); (2) at least 30 days have elapsed since death; and (3) no personal representative appointment is pending or granted in any jurisdiction.
Claim decision deadline
Under 33 M.R.S. §2154, the administrator must approve or deny a claim within 90 days of the date the claim is complete (i.e., all requested information and documentation received). A claim with no action within 90 days is deemed denied.
