Heir claim documents
A claim form prescribed by the administrator and verified (signed) by the claimant, with a copy of a photo ID and a Social Security number. The claim states your relationship to the owner — owner, heir, or representative — and any further requirements are listed on the form the portal generates for you (SDCL 43-41B-25).
Proving a right to claim for a deceased owner
Submit the court order documents showing appointment as personal representative or executor — the will, court appointment, or probate. If the deceased left no will, an affidavit of small estate may be submitted when the SDCL 29A-3-1201 requirements are met. A certified death certificate is requested from the South Dakota Department of Health vital records office.
Decision window
The administrator considers each filed claim within 180 days and gives notice if the claim is denied in whole or in part (SDCL 43-41B-25).
Small estate option
Heirs may avoid full probate by using the SDCL 29A-3-1201 successor affidavit when the entire estate, less liens and encumbrances, does not exceed $100,000, at least 30 days have passed since death, no personal representative has been appointed or applied for, and the decedent incurred no indebtedness to the Department of Social Services for medical assistance for nursing home or other medical institutional care. The affidavit covers personal property, bank accounts, securities, and similar assets. Present it to any holder — including unclaimed property — who must then transfer the property to the successor.
