Steps to take

  1. Determine whether the deceased received Medicaid medical assistance at age 55 or older, or was permanently institutionalized.
  2. Contact the Estate Recovery Office at the Idaho Department of Health and Welfare to confirm whether a recovery claim applies and request the amount.
  3. Address the claim as a debt of the estate before distributing assets to heirs; the Department may file a lien against estate property within 90 days of a request for prompt action or three years from death, whichever is sooner.
  4. Request an undue-hardship waiver if the estate is income-producing property supporting surviving family or recovery would leave heirs needing public assistance.
