How Does Probate Work in Union County, Tennessee?

Losing someone you love is hard enough without the confusion of legal paperwork. Probate in Union County depends on estate size—estates under $50,000 may qualify for a simplified procedure. The Chancery Court accepts filings in person and online.

Do I Need Probate?

The question most families in Union County face first: does this estate actually need to go through the Chancery Court? The answer depends on how assets were titled.

Several categories of assets never go through the Chancery Court: trust property, accounts with named beneficiaries, and anything held in joint tenancy with survivorship rights. Probate applies to what remains—assets owned solely by the deceased, including any that a pour-over will directs into an underfunded trust.

If the estate is worth less than $50,000, a Small Estate Probate Act Petition may be available after waiting 45 days. Otherwise, families in Union County go through standard probate at the Chancery Court.

Filing at the Chancery Court starts with gathering documentation: the original will, a certified death certificate, and records of the deceased's assets. Deeds, bank statements, and vehicle titles establish what was owned and how—which is what determines whether an asset goes through probate.

Clerk and Master Sandra Edmondson presides over probate matters at the Chancery Court. The clerk's office is open Monday - Friday, 8:00 AM - 4:30 PM.

E-filing is available but optional in Union County. Many families filing without an attorney prefer paper filing at the clerk's office.

Who Inherits Without a Will?

If there's no will, Tennessee intestacy statutes control who receives the estate. The rules follow a specific hierarchy of family relationships, and the split between a surviving spouse and children can surprise families who haven't seen it before.

Surviving spouses in Tennessee can claim an "elective share" regardless of what the will says. The percentage varies by years married (up to 40%) and must be filed at the Chancery Court within 270 days.

The Chancery Court can approve a family allowance for the surviving spouse and minor children while the estate is being settled. This has priority over creditor claims.

Creditors must be notified through newspaper publication in Union County for 2 consecutive weeks, and known creditors receive direct written notice. The claim deadline is 4 months from first publication.
