The key to protecting your Mercury accounts is making sure each one has a transfer mechanism in place—either a beneficiary designation or trust ownership. Without one, the account goes through probate, adding time, cost, and court involvement for your family.

Mercury has 9 accounts with different estate transfer rules. Here is how beneficiary designations, trust ownership, and probate apply to each one.

Required Documents

  • Trust name, date established, and tax ID (EIN or SSN)

Special Requirements

  • POD beneficiaries available on Mercury Personal Checking and Savings only; NOT available on business accounts
  • Maximum of 5 individual beneficiaries OR 1 trust beneficiary per account
  • If multiple beneficiaries survive the account holder, funds are split evenly and surviving beneficiaries hold as joint tenants with right of survivorship
  • If no beneficiary is living at the time of the account holder's death, funds pass to the legal representative of the last surviving account owner
  • Mercury cannot open accounts for trusts; the account itself cannot be retitled to a trust (revocable trust accounts listed as "Coming soon" as of 2026-05-23)
  • Business account ownership is governed by the entity's formation documents and applicable state law
  • Multi-member business entities should have clear succession provisions in their operating agreements
