Insurance proceeds are paid directly to the named beneficiary and do not go through probate. How quickly the claim is processed depends on the policy type, documentation, and cause of death.

Documentation required by Globe Life includes Completed Proofs of Death - Claimant Statement form, Certified death certificate showing cause and manner of death (original or certified copy with raised or colored seal required for claims over $50,000; copy accepted for claims of $50,000 or less), and Obituary (if available), along with additional paperwork that varies by account type. An ILIT is an irrevocable trust designed to own a life insurance policy, keeping the death benefit out of the insured's taxable estate. Unlike naming a revocable trust as beneficiary, an ILIT must own the policy. An existing Globe Life whole life, term life, final expense, children's life, or mortgage protection policy can be transferred to an ILIT through an absolute assignment of ownership form. However, the three-year lookback rule under IRC 2035 applies -- if the insured dies within three years of the transfer, the death benefit is included in the taxable estate. To avoid this, an ILIT can apply for and own a new Globe Life policy from inception. The trust pays premiums using gifts from the grantor, and beneficiaries receive Crummey withdrawal notices. Consult an estate planning attorney before establishing an ILIT.
