Frequently asked questions

Yes. An ILIT can own an Assurity life insurance policy, removing the death benefit from the grantor's taxable estate. Use the Transfer of Ownership form (https://www.assurity.com/forms/TransferofOwnership.pdf) to transfer an existing policy to an ILIT, subject to the three-year lookback rule under IRC Section 2035. The trust can also own a new policy from inception. Once transferred, the grantor permanently relinquishes control. Assurity does not establish ILITs; work with an estate attorney to set one up. Yes. Assurity life insurance policies (term, whole life, and universal life) accept a trust as a primary or contingent beneficiary so the death benefit pays directly into the trust at the insured's death, bypassing probate. Complete the Beneficiary Designation form (https://www.assurity.com/forms/BeneficiaryDesignation.pdf) and provide the full legal trust name, date the trust was established, and trust EIN. A Certificate of Trust or trust abstract is preferred over the full trust document. Disability income and critical illness policies cannot name a trust as beneficiary because benefits are paid directly to the insured during their lifetime.

Individual life insurance products (Term Life, Whole Life Protect+, Whole Life Perform+, and Universal Life) can name a trust as beneficiary and can be owned by an ILIT for estate tax planning. Disability income (Century+ and Income Protection+), critical illness, accidental death, and group employer-sponsored products cannot be retitled to a trust and do not support trust beneficiary designations, because benefits are paid directly to the insured (or to the estate, in the case of accidental death) during their lifetime. Group term, whole life, and critical illness coverage offered through an employer pays the death benefit to the employee's named beneficiary on file with the plan administrator.
