Under IRC Section 72(u), a trust-owned annuity qualifies for tax deferral only if the trust benefits solely natural persons or is a grantor trust. Jackson will treat trust-owned contracts meeting these requirements as tax deferred. However, trust ownership eliminates spousal continuation (the right of a surviving spouse to step into the contract as new owner and preserve the income guarantee) and eliminates the nonqualified stretch (the right of a non-spouse beneficiary to receive distributions over their life expectancy). Jackson's Annuity Titling Guide recommends naming the trust as beneficiary rather than as owner to preserve these benefits. Consult an estate attorney before retitling.
Jackson accepts either a completed Certification of Trust (Form X5335 for non-New York states, Form N5335 for New York) or a complete copy of the trust agreement including all signature pages and any amendments. The Certification of Trust form is typically simpler and avoids disclosing the full trust terms. The trust EIN and trustee name must also be provided on the Beneficiary Designation form (X3041 for non-New York, N3041 for New York). Submit forms by mail to Jackson, P.O.
