Claude is Anthropic's AI assistant, competing with ChatGPT. As of May 2026, paid consumer plans are Claude Pro ($20/month or $17/month annual), Claude Max at $100/month (5x Pro usage) and $200/month (20x Pro usage), plus Team and Enterprise tiers. An Anthropic account holds conversation history, Claude Projects (organized workspaces with custom instructions and knowledge), API credits, and saved artifacts. Anthropic has NO published bereavement policy, no account transfer mechanism, and no legacy contact feature. Upon account termination, Anthropic may delete all associated data at its option. Conversations are removed from chat history immediately on deletion and purged from backend storage within 30 days. Claude for Work (Team/Enterprise) accounts have better data governance through organizational ownership.

Under Claude's terms, accounts are not property of the account holder and are forfeited when the account closes at death. No estate planning document—will, trust, or otherwise—can override this forfeiture.

What happens at death

Anthropic has no published bereavement or deceased user policy. The Consumer Terms of Service (last updated October 8, 2025) state: "These Terms may not be transferred or assigned by you without our prior written consent, but may be assigned by us without restriction." No provisions address death, succession, inheritance, or estate access. Upon termination, "we may at our option delete any Materials or other data associated with your Account." Anthropic may terminate accounts inactive for over 1 year without a paid subscription, providing notice before doing so. If Anthropic terminates a paid subscription on its own initiative, it refunds remaining fees on a pro-rata basis. Account sharing is prohibited in consumer plans.

How to protect your Claude accounts

Anthropic PBC's terms state that accounts are forfeited when the account holder dies. Lifetime planning is the only path to extracting value from the account before that happens.

7 steps for managing your Claude accounts during your lifetime:

Export your conversation history regularly at claude.ai > Settings > Privacy > Export data. Store exports externally. Anthropic may delete all data upon account termination at its option, and account-to-account migration is not supported.

Document your Claude Project configurations externally. Copy custom instructions, knowledge base contents, and important artifacts. Projects cannot be transferred between accounts.

Record your Anthropic login credentials and any 2FA recovery codes in your password manager and share access with your executor. Anthropic has no estate access process, so direct login is the only reliable way to export data, cancel a Pro or Max subscription, and delete the account.

If you use the Anthropic API: keep prepaid credit balances small and document API keys separately at console.anthropic.com. API workloads belong under a Commercial Terms account, not a personal Claude.ai account.

For business-critical AI workflows: use Claude for Work (Team or Enterprise) with multiple administrators rather than a personal Pro or Max account. Organizational accounts have better data persistence and succession through the Primary Owner role and configurable data retention.

If you use Claude Code or other developer tools: ensure your code, configurations, and outputs are stored in version control (Git), not solely inside the Claude account.

Disable training opt-in if you do not want de-identified conversation data retained for up to 5 years in Anthropic's training pipelines. Manage at Settings > Privacy.

Family sharing

Anthropic accounts are non-transferable. The TOS explicitly prohibit assignment without prior written consent. There is no family sharing, delegate access, or multi-user feature for consumer accounts. Claude for Work (Team/Enterprise) allows organizational access with Primary Owner control and configurable data retention. Consumer Pro/Max accounts are single-user only. Anthropic offers gift subscriptions but these create new accounts, not shared access.

Claude does not offer a beneficiary designation feature. Without this option, accounts cannot be assigned to a named recipient through the program's own settings.

Only with login credentials. The account holder (or anyone with the password and 2FA) can export data at claude.ai > Settings > Privacy > Export data; the email link expires 24 hours after delivery and export only works on the web app and Claude Desktop, not iOS or Android. Anthropic has no formal process for estates to request data, and account-to-account migration is not supported.

Not immediately. After a standard account deletion, the email address is blocked from creating a new Claude account for 30 days. If the account was terminated for a Usage Policy violation, the email is permanently blocked from creating a new Claude account.
