You can, but the tax consequences are different and the annuity ownership form says so on its face. Protective's Ownership Change Annuity Service Form (Form RET-2405, at https://www.lad3.protective.com/protectivelife/forms/pdf/RET-2405_Ownership_Change_Form_07.24.pdf) warns in Section 1 that an ownership change may create a taxable event, and that under Rev. Proc. 2011-38 an ownership change within 180 days of a partial 1035 exchange can cause additional taxable income. The new designation also cancels all previous ownership designations. If the new owner is a trust, Protective requires the Trustee Certificate or the trust document showing the trust name, trustee name, trust date, tax ID, and trustee signature. Naming the trust as BENEFICIARY of the annuity (Form RET-2403) carries no such transfer-tax exposure and is the more common path. Annuity service: 1-800-456-6330, fax 205-268-6479, P.O.
