There are two ways to keep your Amerant accounts out of probate: adding beneficiary designations and retitling eligible accounts into a revocable living trust. Which approach works best depends on the account type and your overall estate plan.
Each of Amerant's 5 accounts has different rules for how it transfers at death. The sections below explain the options for each.
Required Documents
- Trust name, date established, and tax ID (EIN or SSN)
Special Requirements
- No online/self-service POD designation -- banking center or Customer Care only
- A POD beneficiary acquires no interest in the account during the owner's lifetime; the owner can remove beneficiaries, change the account type, or withdraw the funds at will
- A POD beneficiary must survive the owner to take; if none survives, the deposit belongs to the estate of the last surviving owner
- For a minor POD beneficiary, Amerant pays the minor's legal guardians and may request the birth certificate and proof of custodianship
- POD designations on Amerant accounts are governed by applicable Florida pay-on-death law (the agreement text still cites Florida / Texas law)
