Step 3 of the HSA Designation of Beneficiary Form requires the spouse of a married accountholder to sign a consent paragraph before anyone other than the spouse can be named primary beneficiary, and that signature must be acknowledged before a notary public in the notary block at the bottom of the form. Both signatures also need a witness who is 18 or older and is not the spouse. HSA Bank also cannot process a designation without a valid Social Security number for each beneficiary. Note that a divorce, annulment, or other legal termination of the marriage automatically revokes a spouse beneficiary designation.
