A successor in interest is someone who received an ownership interest in the mortgaged home — through inheritance, a divorce decree, or a living trust — but was not an original borrower on the loan. Under the Consumer Financial Protection Bureau's Regulation X (12 CFR 1024.30-1024.41), the servicer must recognize that status once the person documents ownership and identity, which lets them receive loan information, make payments, and apply to assume the loan. Fay states it will provide a list of the documentation needed to confirm identity and ownership interest. A successor in interest who did not sign the note is generally not personally liable for the debt, though the home can still be foreclosed if payments stop.
Before an executor's authority or a successor-in-interest status is documented, Fay can add an authorized party through its Authorization to Release Information form. The form is valid when signed by all borrowers and co-borrowers on the account; return it to Fay Servicing, LLC, Attn: Applications, 440 S. An executor or administrator establishes full authority instead with Letters Testamentary or Letters of Administration.
