What happens if you miss the deadline to file for probate?
Missing a probate filing deadline can create serious complications for settling an estate. Most states set a window — often ranging from a few months to a few years after death — within which the will must be submitted to the probate court. Filing late can result in the court refusing to admit the will, assets being distributed as if no will existed, or creditors challenging the process. A revocable living trust is one way families structure their estates to transfer assets outside of probate entirely, which means probate deadlines may not apply to trust-held property.
