Learn how to fund a trust by transferring property, bank accounts, and investments. Discover the essential steps to properly move assets into your trust.
Assets not transferred into your trust remain in your individual name and will likely go through probate when you pass away, defeating one of the main purposes of creating the trust. This is called an "unfunded trust" and it's one of the most common estate planning mistakes. You can transfer forgotten assets at any time while you're alive, but your successor trustee cannot transfer assets after your death - those assets would need to go through the probate process to eventually reach your trust beneficiaries.
